Pension Benefit Guaranty Corporation And NAGE, Local R3-77, Case No. WA- CA-00602 (Decided August 20, 2003)
The complaint alleged that the Respondent violated § 7116(a)(1) and (5) of the Federal Service Labor-Management Relations Statute by implementing an organizational change, and by physically relocating two employees, without completing bargaining with the Charging Party. The Judge found that the Respondent did not violate the Statute and dismissed the complaint.
The Authority found that the Respondent violated § 7116(a)(1) and (5) of the Statute. In addition, the Authority granted the GC's requested relief but only to the extent set forth in this decision.
