DECISION AND ORDER APPROVING SETTLEMENT AND CANCELLING HEARING DATE
This matter arises under the Immigration and Nationality
Act (INA) pursuant to regulations at 29 C.F.R. Part 507.815 - H-1B
Specialty Occupations under the Act.
This matter was assigned to the undersigned
administrative law judge for the purpose of conducting a formal hearing and
issuing a decision and order. Pursuant to a Notice of Hearing and Pre-Hearing Order dated January 9, 1997, this matter was set for a formal
hearing on Thursday, January 30, 1997, in Long Beach, California.
However, prior to said hearing, on January 21, 1997,
this office received the parties' "Settlement Agreement". The
parties' Settlement Agreement appears to have been executed by attorneys
for the Respondent and Prosecuting Party. The Prosecuting Party and the
Respondent, do agree that this matter has been fully and finally settled
on its merits by payment of ,000.00 by Respondent to the Prosecuting
Party and agreement between the parties to a General Release. A copy of
this agreement is attached hereto and incorporated herein. The undersigned
has reviewed the entire agreement and finds that it is fair, adequate and
reasonable for all parties.
ORDER
Based upon the foregoing, IT IS HEREBY ORDERED
that the settlement agreement in the above-styled matter is approved. The
hearing in this matter, which was previously scheduled for January 30,
1997, in Long Beach, California, is HEREBY CANCELLED.
