ORDER OF REMAND

    This matter was assigned to the undersigned for hearing on February 3, 2004. On February 4, 2004, the matter was set for April 1, 2004 hearing. At the request of the Prosecuting Party, hearing was reset for June 28, 2004, a date convenient to the Prosecuting Party.

    Pending is a further motion by the Prosecuting Party to continue the hearing until another (apparently unrelated matter) is resolved.

    As there is some question whether the Prosecuting Party will ever be prepared to pursue this case, and the matter has been pending on the docket for some four months, it is hereby

    ORDERED, that this matter be and the same is REMANDED to the District Director until such time as the Prosecuting Party may desire to seasonably pursue hearing thereof.
