ORDER OF DISMISSAL

   This matter arises under the H-1B provisions of the Immigration and Nationality Act (INA), and the applicable regulations issued thereunder at 29 C.F.R. § 507 et seq., and 20 C.F.R. Part 655, Subpart H and I.

   On Dec 4, 2002, Jack Lee Associates, Inc., Respondent, filed an appeal of the November 19, 2002 Notice of Determination issued by the Administrator, Wage and Hour Division. The record indicates that the Administrator determined that Respondent violated INA, and owes back wages in the amount of $44,985.39 to six H-1B nonimmigrants.

   On January 22, 2003, this Office received a letter from Respondent requesting a withdrawal of their appeal. Accordingly, it is HEREBY ORDERED that the request to withdraw the appeal is GRANTED and this matter is marked CLOSED.
