Content Note:
The Employee Benefits Security Administration (EBSA) [formerly
Pension and Welfare Benefits Administration (PWBA)] is responsible for administering and
enforcing the fiduciary, reporting and disclosure provisions of Title I of the Employee
Retirement Income Security Act of 1974 (ERISA). OALJ's role under ERISA is limited to
conducting hearings where a party appeals certain EBSA civil money penalties for failure or
refusal to file an annual report, ERISA § 502(c)(2) and § 502(c)(5), or for a prohibited transaction, ERISA § 502(i). The information contained in this collection is limited to procedural regulations relating to such hearings, and administrative-adjudicative decisions. EBSA's Home Page, however, contains an extensive collection of information concerning legal rights and responsibilities relating to employment benefits.
