Correction to Information Bulletin 08-04NMFS Announces That Certain Provisions of the Bering Sea and Aleutian Islands Groundfish Retention Standard Program Are Invalid and Will Not Be Enforced by NMFS On December 18, 2007, the U.S. Court of Appeals for the District of Columbia Circuit issued a decision invalidating three monitoring and enforcement requirements associated with the Bering Sea and Aleutian Islands Groundfish Retention Standard Program that would have been effective on January 20, 2008. In accordance with the court’s ruling, NMFS announces that the regulation at 50 C.F.R. 679.7(m)(5) is invalid and void and will not be enforced by NMFS. NMFS also announces that the phrase, “at a single location”, contained in the first sentence of 50 C.F.R. 679.27(j)(5)(ii), and the phrase, “that each haul is weighed separately”, contained in the second sentence of 50 C.F.R. 679.27(j)(5)(ii), are invalid and void and will not be enforced by NMFS. Finally, NMFS announces that the last sentence of 50 C.F.R. 679.27(j)(5)(iii) is invalid and void and will not be enforced by NMFS.
