DECISION
This case involves a request for hearing filed by the
Respondent, contesting a civil penalty assessed by the Pension
and Welfare Benefits Administration, U.S. Department of Labor,
under provisions of the Employee Retirement Income Security Act
of 1974, as amended, 29 U.S.C. §1001, etseq.,
for deficiencies in annual reports for plan years 1989-1992,
inclusive.
Prior to my scheduling a hearing, the parties filed a joint
"Stipulation for Dismissal and Order," having agreed to settle
their dispute. The findings, terms and conditions of the
settlement agreement are incorporated in, and attached to, this
decision.
Accordingly, the parties are ordered to fully comply with
their agreement and this case is dismissed, with prejudice. This
decision constitutes final agency action within the meaning of 5
U.S.C. §704. 29 C.F.R. §2570.6(b)-(d).
