Subject:                        Complaint Processing Responsibilities

 

The EEOC recently sanctioned a bureau for failure to include the EEO Counselor’s Report as part of the contents of the Complaint File.  In another case, EEOC remanded a complaint to the bureau for a supplemental investigation, which was never carried out. 

 

As EEO professionals, we are responsible for ensuring the integrity of the complaints process.  It is important that we adhere to Title 29, Code of Federal Regulations, Section 1614.  § 1614.105 through § 1614.108 discusses complaints processing, investigative responsibilities, and the contents of a complaint file.  Management Directive 110, Chapter 6, addresses the development of impartial and appropriate factual records.  Investigations and contents of the complaint file are also addressed in this chapter.  Interior’s Departmental Manual, 373 DM 5, also addresses complaints processing responsibilities.
