Subject:     Transmittal of files for Hearing- New York District Office (Equal Employment Opportunity Commission)

This Directive provides further guidance on the transmittal of files for discrimination complaint cases that are pending hearing in the New York District Office of the Equal Employment Opportunity Commission (EEOC) Office. In Equal Opportunity Directive Number 2001-19, dated September 27, 2001 you were advised that the New York District Office was destroyed on September 11, 2001 as well as case files and other materials stored therein.

We recently received correspondence prescribing new procedures for processing new requests for hearings in the area covered by the New York District office.  Through December 21, 2001, when a report of investigation (ROI) is issued to a complainant in the area covered by the New York District office please advise him/her that if they wish to request a hearing, to send the requests to the following office:

Washington Field Office
1400 L Street, N.W., Suite 200
Washington, D.C. 20005

Further, copies of any requests for hearings received by Bureaus from complainants in the New York District, on or after August 13, 2001, should be provided to the Washington Field Office as well. Until further notice, all instructions for requests for hearings in the New York area should be provided as indicated above.

For your further information, we are providing you with a copy of the electronic mail communication received concerning this guidance.  Please share this information with your field organizational units.

As I told you earlier, the New York District Office of the Equal Employment Opportunity Commission was located in the World Trade Center.

We expect to open a temporary office in Manhattan within the next several weeks.  However, because it will take some time to move into a permanent location, FOR ALL AGENCIES EXCEPT THE USPS, we are establishing new procedures for processing new requests for hearings in the area covered by the New York District.

We ask that through December 31, 2001, in the notice required by 29 CFR 1614.108(f), you advise complainants in the area covered by the New York office who wish to request hearings to send their requests to our Washington Field Office at:

Washington, D.C.  20005

We also ask that all agencies except USPS send to the Washington Field Office copies of any requests for hearings from complainants in the New York District received by you on or after August 13, 2001.
