Major changes to bankruptcy legislation not covered in Personal Financial Choices are proposed to go into effect mid-October 2005. The major changes include implementation of a “means test” to determine whether a debtor is eligible for chapter 7 (liquidation) or must file under chapter 13 (wage-earner repayment plan). For up to date information on the new Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) visit the United States Trustee Program.
