Board of Appeals

The Board of Appeals is established by City Ordinance and consists of five (5) members appointed by the Mayor for a specific term. The Board of Appeals is the appellate Committee responsible for hearing appeals of Zoning Hearing Examiner Decisions on special exceptions to the Zoning Ordinance. The Zoning Ordinance establishes three classes of special exceptions: conditional uses in various Zoning Districts ("Zones"); variances from the strict literal interpretation of the provisions of the Zoning Ordinance, and expansion of Non-Conforming Uses.

The Board may only consider evidence in the record of hearing of the Zoning Hearing Examiner.

Appeals of Board of Appeal decisions are heard by the City Council.
