XXXXm9)%`|0* `[ ERWF(m (#(#(#(# UNITEDSTATESENVIRONMENTALPROTECTIONAGENCY   Ѐ WASHINGTON,D.C.20460   (#(#(#(#@'June1,1998#X^XX X# XXXX^ 8     `     h      p    2X XԀOFFICEOF $ t    `     h      p ENFORCEMENTAND   `     h      p COMPLIANCEASSURANCE# XX 2#    #X^XX XQ# XXXX^ @- June1,1998 @-@Revision toAddendumtoMobileSourceEnforcementMemorandum1A \  SUBJECT: ` RevisedTamperingEnforcementPolicyforAlternativeFuelConversions 8  A.Purpose: ` Thepurposeofthisdocumentistorevisethetamperingenforcementpolicyfor `  alternativefuelconversionsascurrentlyprovidedintheU.S.EnvironmentalProtectionAgencys(EPA)AddendumtoMemorandum1Ainresponsetocommentsandsuggestionsreceivedbytheregulatedcommunityandotherstakeholders.B.Background:󀀀EPAissuedanAddendumtoMobileSourceEnforcementMemorandum1A  (Addendum)onSeptember4,1997,toaddressemissionsincreasesthatresultedfromtheconversionofgasolinepoweredvehiclesandenginestooperateoncompressednaturalgas(CNG)andliquefiedpetroleumgasoline(LPGorpropane).ThebackgroundandbasisfortheissuanceoftheAddendumandthecontentsofthenewpolicyarefullycontainedintheAddendum.SinceissuanceoftheAddendum,EPAhasreceivedanumberofinquiriesandrecommendationsthatcertainrevisionstothepolicywouldbeinthepublicinterestwhilenotjeopardizingtheeffectivenessoftheAddendum.EPAbelievessomeofthosesuggestionsareappropriateandisrevisingtheAddendumasdescribedbelow.C.RevisedPolicy:Effectiveimmediately,theAddendumtoMemorandum1Aisrevisedas 4 follows:  1.InlieuofmeetingthetestingrequirementsunderOptions1,2or3oftheAddendumformodelyear1997andoldermotorvehiclesandengines,compliancewiththerequirementsfordemonstratinga reasonablebasismaybeachievedbycompletingbacktobackI/M240emissionstestsascontainedin40CFRPart51,SubpartS,for each convertedvehicleusing $# gasolineinthevehicleorenginesoriginalconfigurationandwitheachoperationalfuelafterconversionprovided:  (a)Alltestsareconductedinaccordancewiththespecifiedprotocolsunder40CFRPart51,SubpartS,  (b)Thevehicleastestedintheoriginalconfigurationwithgasolinemeetstheapplicablestandardsunder40CFR51.351,  (c)Theexhaustemissionsofeachregulatedpollutantafterconversionusingthealternativefuelarenogreaterthan.90timestheemissionslevelsforeachpollutantbeforeconversion,exceptthatnohydrocarbonstandardshallapplyforoperationexclusivelyusingCNG,  (d)Ifdualfueloperationisretained,theexhaustemissionsofeachregulatedpollutant - )-4 afterconversionusingtheoriginalcertificationfuelarenogreaterthantheemissionslevelsforeachpollutantbeforeconversion,and  (e)Nopartyshallconvertmorethan25vehiclesorenginesofanysinglevehicle/enginefamilycombinationinanycalendaryearunderthisI/M240protocol.   (    2.ThefinaldateforbothtestingandinstallationsunderOption3oftheAddendumisextendedfromApril24,1998andDecember31,1998,respectively,toJune30,2000,foruptoandincluding1999modelyearvehiclesandengines.Allalternativefuelconversionsofmodelyears2000andlatervehiclesandenginesandconversionsofmodelyear1998and1999vehiclesandenginesafterJune30,2000,mayonlybeperformedinaccordancewithOptions1or2oftheAddendum.  3.AsanalternatetoenginedynamometertestingforheavydutyengineconversionsunderOption3foraspecificheavydutyenginefamily,themanufacturermaydemonstratea reasonablebasisbyperformingbacktobackchassisdynamometeremissiontestsinaccordancewiththeUrbanDynamometerDrivingScheduleforHeavyDutyVehicles(UDDS)containedin40CFRPart86AppendixI,Paragraph(d),provided:  (a)TheexhaustemissionsresultsforTHC,NOxandCOmeasuredduringtheUDDSafterconversionandwhenoperatedexclusivelyorincombinationwiththealternativefuelarenogreaterthan.90timesthebaselineemissionsforTHCandNOxandnogreaterthan1.00timesCObeforeconversion,exceptthatNMHCafterconversionshallbecomparedtothebaselineTHCbeforeconversioninthecaseofoperationexclusivelywithCNG,and  (b)Alltestsareperformedinaccordancewithallspecifiedprotocolsin40CFRPart86,SubpartM,includingvehiclepreparation,dynamometerloading,emissionsmeasurementsanddrivingscheduleexceptthatcommerciallyavailablefuelmaybeusedforvehiclepreconditioningandbaselinetesting.  4.AsanalternatetoenginedynamometertestingforheavydutyengineconversionsunderOption3foraspecificheavydutyenginefamilyorthealternateproceduresprovidedinparagraph3.aboveortheAddendum,anypartymayproposeanalternateheavydutyvehicleorenginetestprocedurewhichoperatesthesubjecttestenginethrougharangeofenginespeedandloadconditionsreasonablyrepresentativeofbothurbanandhighwaydriving,measurestheexhaustemissionsspecifiedaboveonagramspermileorgramsperbrakehorsepowerhourbasisandspecifiesappropriatepass/failcriteriaequivalenttoparagraph3.aboveforthepurposeofdemonstratinga reasonablebasisunderEPAstamperingenforcementpolicy.AnysuchproposedproceduresshallbesubmittedtotheDirector,AirEnforcementDivision(2242A),OfficeofEnforcementandComplianceAssurance,U.S.EPA,401MStreet,S.W.,Washington,D.C.20460forconsiderationandapproval,ifappropriate,underthispolicypriortotheinitiationofanyvehicleprocurement,modificationortesting.  5.TheresultsoffederalemissionstestsconductedunderOption3foraspecificenginefamilymaybeappliedasa reasonablebasisforuptoamaximumofthreeadditionalenginefamiliestothattestedfordemonstratingcompliancewiththeapplicableTier1emissionstandards -&* forthatclassofvehicleorengineasspecifiedin40CFRPart86provided:  (a)Theenginefamilytestedinaccordancewith40CFRPart86meetstheapplicableTier1standardsforthatvehicleorengineclasswiththeapplicationoftheappropriatedeterioration < factorasprovidedunderOption3,  (b)Theenginefamilytestedaboverepresentsthe worstcaseforemissionsoftheapplicableenginefamiliesasbasedonengineorvehicleparametersreasonablyexpectedtoadverselyaffecttheemissionresultssuchasmaximumgrossvehicleweight,maximumenginedisplacementandanyotherreasonableengineeringjudgements,  (c)Thedeterminationof worstcaseisconfirmedbyconductingI/M240emissionstestsofonevehicleorengineofeachapplicableenginefamilyafterconversion,  (d)TheresultsoftheI/M240testsofthethreeadditionalenginefamiliesarenogreaterthantheI/M240emissionresultsoftheoriginalenginefamilytested,  (e)Theadditionalenginefamiliesmeetthecriteriaspecifiedinparagraphs3.(b)(4)B.throughD.oftheAddendum,and  (f)Theevaporativeemissioncontrolsystemremainsasinstalledbytheoriginalenginemanufacturerifgasolineoperationisretained.  6.ForbothLEVandTier1vehiclesorengines,anyadditionalenginefamiliesforwhichemissiondatawouldbecarriedacrossunderparagraph5.aboveorparagraph3.(b)(4)underOption3oftheAddendummustbeproducedbythesamevehicleorenginemanufacturerastheoriginalenginefamilytested.  7.Anypartyresponsiblefordemonstratingcompliance,installing,converting,sellingormarketingalternativefuelconversionsystemsinaccordancewiththerequirementsoftheAddendumandthisrevisedpolicyshallretaintheresultsofalltests,installationsandsalesofsuchsystemsasspecifiedunderOption3oftheAddendumorthisRevisionforinspectionbyEPAforfive(5)yearsfollowingcompletionofthetesting,installingormarketingofsuchsystems.  8.AnyprovisionsorrequirementsoftheAddendumnotextendedorrevisedhereinremainineffectasprovidedintheAddendum.C.Conclusion:EPAbelievestherevisionsdescribedabovewillprovideadditionalflexibilityand "
