A Synopsis of Mining Law for
New Zealand


The government agency with responsibility for enforcing safety and health laws and regulations for mines in New Zealand is the Department of Labour. Specifically the safety and health agency is the Occupational Safety and Health Service of the Department of Labour, New Zealand.

The duties of employers concerning occupational safety and health in New Zealand is the Health and Safety in Employment Act of 1992. A copy of the law can be found at :
http://www.osh.govt.nz/law/hse.shtml. It is a comprehensive law which includes provisions regarding: employer duties, training, inspections (including medical), and regulations.
On October 14, 1999, the New Zealand Department of Labour, Occupational Safety and Health Service is in the issued new health and safety regulations for underground mining. The regulations include numerous provisions including those relating to such issues as inspections, accidents, ventilation, and explosives. The new regulations should be posted on the Department's web site in the near future.
