CHAPTER 432 - PERFORMANCE-BASED REDUCTION IN GRADE AND REMOVAL ACTIONS

SUBCHAPTER 1 - GENERAL PROVISIONS

1-1. SCOPE AND PURPOSE

a. Policy Guidance

This Chapter provides mandatory Departmental policy in addition to the requirements of law and 5 C.F.R. Part 432.

b. Delegations of Authority

(1) To Agency Heads. Authority is hereby delegated to each Agency Head totake actions under the provision of 5 U.S.C. 4303, consistent with this Chapter, for employees not excluded by FPM Chapter 432, Subchapter 1-3(f).

(2) Re-delegation. Each Agency Head shall re-delegate authority under this Chapter to that level of personnel management that has clearly demonstrated the knowledge, experience, and capability to take the actions.

(3) Relation to the Office of Personnel
(a) Director of Personnel's Authority. No delegation or authorization prescribed herein shall preclude the Director from exercising any of the powers or functions, or from performing any of the duties conferred herein.
(b) Action by the Director of Personnel. The Agency shall, upon issuance, send copies of the proposal and decision letters affecting GM-14 and GM-15 employees, to the Director, Employee Relations Division.

1-4. PRINCIPAL REQUIREMENTS FOR TAKING ACTION UNDER PART 432

a. (3) Notification of Deficient Performance

(c) Notification of deficient performance shall be in writing for Performance Management System employees.

3-2. PROCEDURES

b. Advance notice

(2) Extension of the advance notice period. In addition to the 30-day advance notice period stated in the FPM, authority is granted to each Agency Head to extend the notice period an additional 30 days. If the agency needs an extension beyond 60 days, for any reason not stated in the FPM, authority is granted to each Agency Head to request prior approval for such an extension from the Chief, Employee Relations Division, Office of Labor Relations and Workforce Performance, Room 7412, Office of Personnel Management, 1900 E Street, N.W., Washington, D.C. 20415.
