MEMORANDUM OF UNDERSTANDING Between U.S. DEPARTMENT OF AGRICULTURE And THE COUNCIL OF 1890 UNIVERSITIES

This Memorandum of Understanding sustains the partnership between USDA and the historically black colleges eligible to receive funds under the Second Morrill Act of August 30, 1890, including Tuskegee University. This Memorandum of Understanding reflects the commitment of USDA, the historically black colleges and Tuskegee University to improve USDA's outreach efforts with these colleges and universities. This MOU supersedes the July 1, 1991, MOU between the Council and USDA.

USDA provides many programs and services to benefit rural communities and farm enterprises. Research has identified over 11,000 refugees involved in farming and rural enterprises. USDA and the U.S. Department of Health and Human Services agreed to work together to improve the coordination of programs and services to refugee and low-income individuals who are engaged in farming and rural enterprises in the United States. Their agreement is formalized in a Memorandum of Understanding.

Two offices within the U.S. Department of Health and Human Services Administration for Children and Families, specifically the Office of Refugee Resettlement and the Office of Community Services, are working together with USDA in this partnership. The Office of the Assistant Secretary for Civil Rights, through its Office of Outreach, coordinates USDA activities under the Memorandum of Understanding. USDA established a partnership with the League of United Latin American Citizens (LULAC). LULAC is the largest and oldest Hispanic organization in the United States. LULAC advances the economic condition, educational attainment, and civil rights of Hispanic Americans through community-based programs.

USDA and LULAC entered into a Memorandum of Understanding known as "Juntos Podemos" (Together We Can), that reflects USDA's and LULAC's commitment to strengthen USDA's relationship and outreach activities with educational institutions, professional and minority organizations and the overall Hispanic community. The Office of Outreach, within the Office of the Assistant Secretary for Civil Rights, has the lead responsibility for coordinating activities under the Memorandum of Understanding. Basu v. Veneman is an administrative class action complaint of employment discrimination filed in 1999 by Dr. Arun Basu on behalf of a class of Asian/Pacific Islander employees of the Department of Agriculture.

Under the leadership of the Assistant Secretary for Civil Rights, a settlement was negotiated and approved by the Equal Employment Opportunity Commission. The settlement agreement took effect on June 6, 2005 and remains in effect for three years. The Office of the Assistant Secretary for Civil Rights is responsible for monitoring implementation of the settlement agreement.

Under the terms of the settlement agreement, USDA will establish a Development Opportunity Placement Program, a Graduate Scholarship Program, and a Department-wide job fair.

Pigford v. Glickman (now Pigford v. Schafer)

Pigford v. Glickman is a class action lawsuit brought by African American farmers who alleged that USDA discriminated against them on the basis of their race in its farm credit and non-credit benefit programs. The Office of the Monitor was established by the Pigford v. Glickman Consent Decree to assist claimants and provide information about the relief that claimants are entitled under the Consent Decree. For information about this class action lawsuit, contact the Office of the Monitor.
