The complaint alleged that the Respondent violated § 7116(a)(1) and (5) of the Federal Service Labor-Management Relations Statute by eliminating the use of metal detectors at the Respondent's facility without giving the Union prior notice and an opportunity to bargain. The Judge found that the Respondent violated the Statute as alleged. The Authority adopted the Judge's findings, conclusions, and recommended Order, to the extent consistent with this decision.
The Authority found that the Judge correctly found that the Respondent violated the Statute by failing to bargain over the impact and implementation of the removal of the magnetometer; that the Judge did not err in finding that there was no policy prohibiting the use of magnetometers prior to May 2002 and that the Judge did not err in awarding status quo ante relief.
