The Arbitrator found that the Agency improperly disciplined the grievant by extending her reassignment to a medical supply technician position, and he sustained the grievance. In the subsequent remedy award, the Arbitrator awarded backpay and attorney fees and directed the Agency to reassign the grievant to her operating room technician position.
The Authority denied the Agency's nonfact, exceeded authority, and essence exceptions, and remanded the matter to the parties for resubmission to the Arbitrator, absent settlement, for clarification. The Authority noted that it was unable to determine whether there was an unjustified or unwarranted personnel action that would support an award of backpay and attorney fees.
