The Arbitrator dismissed the grievance, finding that it was untimely filed under the parties' agreement. The Authority denied the Union's exceptions dismissing arbitrtability issues and finding that the award did not fail to draw its essence from the parties' agreement, that it was based a nonfact, that the Arbitrator exceeded his authority, or that it was contrary to law, specifically the Back Pay Act and the Barring Act.
