Each appeal involved the negotiability of one proposal concerning the Agency's decision to fill three claims representative vacancies. The Authority found that the proposals were outside the duty to bargain.
The Authority found that the proposals affected management's right to assign work under § 7106(a)(2)(B) of the Statute. The Authority further found that the proposals did not constitute appropriate arrangements under 7106(b)(3), nor a procedure under § 7106(b)(2).
