PROPOSAL: Consider proposed amendments to District Regulation 1: General Provisions; Regulation 2: Permits, Rule 1: General Requirements; and Regulation 3: Fees and approve a Notice of Exemption from the California Environmental Quality Act (CEQA).
SUMMARY: The proposed amendments address comments made by affected industry members at the May 17, 2000 Board of Directors’ meeting, at which Regulation 1 and 2 changes were discussed and adopted.
 
RECOMMENDED ACTION:

Adopt the attached resolution:
  1. Amending Regulation 1: General Provisions; Regulation 2: Permits, Rule 1: General Requirements; and Regulation 3: Fees
  2. Certifying the Notice of Exemption.

Proposal
The proposed amendments address comments made by affected industry members at the May 17, 2000 Board of Directors Meeting, at which other Regulation 1 and 2 changes were discussed and adopted. The proposed amendments will:
  • Revise the requirement that certain monitors be calibrated and maintained in accordance with manufacturers specifications to allow operators to develop adequate alternative calibration and maintenance procedures.
  • Clarify what types of process and equipment changes are to be considered "alterations" for purposes of New Source Review.
  • Revise the definition of "modification" to allow continued use of legitimate existing grandfathered capacity for sources that were built before the District started permitting new sources in 1979.
  • Revise the initial reporting requirements for air emission monitor breakdowns.
  • Miscellaneous language clarifications to improve rule compliance and enforcement.
  • Clarify the fee requirements for alterations and modifications of permitted sources.

Based upon comments received, staff proposes two minor changes to the proposed amendments contained in the public notice package. Due to a clerical error, an older draft for 2-1-128 was included. The description in the staff report discusses the correct staff proposal. The second change incorporates clarifying language into 2-1-233 suggested by an industry commentor that does not affect the intent of the section. Staff requests that the language included on the errata sheet be incorporated into its proposed amendments.
