ARB CASE NO. 97-063
ALJ CASE NO. 91-SWD-0001
DATE: February 5, 1998

In the Matter of:

ERNEST A. OLIVER
   COMPLAINANT,

   v.

HYDRO-VAC SERVICES, INC.,
   RESPONDENT.

BEFORE: THE ADMINISTRATIVE REVIEW BOARD

SUPPLEMENTAL ORDER

We issued a Final Decision and Order on Remedies in this case on January 6, 1998, which set out the Administrative Law Judge's recommendations, including the recommendation of an award of $6,000 in attorney's fees and costs, without explicitly adopting that recommendation. Respondent did not object to the fees and costs recommended by the ALJ in its Brief Regarding Recommended Decision and Order on Remedies. In order to remove any potential confusion, we hereby specifically adopt the ALJ's recommendation that Complainant be awarded $6,000 in attorney's fees and costs.

   SO ORDERED.
