NOTICE OF CASE CLOSING
On January 26, 1996, the Secretary of Labor issued a Decision and Order of
Remand in favor of Complainant, and on August 14, 1996, the Administrative Review Board issued
a Final Decision and Order affording relief in this case arising under the Surface Transportation
Assistance Act of 1982, 49 U.S.C.A. §31105 (West 1994).1 On appeal, the United States Court of Appeals
for the Second Circuit granted the petition filed by Respondent, Brink's Inc., vacated the decision
of the Secretary, and directed the Secretary to enter decision in favor of Brinks, Inc. See Brinks,
Inc. v. Herman , No. 96-4162, 1998 WL 337259 (2d Cir. June 25, 1998). Accordingly, this
notice constitutes the final administrative action, entering decision in favor of Respondent, and this
case IS CLOSED .
