Effective May 3, 1996, the Administrative Review Board
replaced the Office of
Administrative Appeals, the Wage Appeals Board and the Board of
Service Contract Appeals.

19982 (1996). The ARB's delegated review authority includes review of ALJ decisions arising out of
OFCCP-related hearings.
Secretary's Order 1-2002 replaced Secretary's Order 02-96, effective September 24, 2002. Secretary's Order 1-2002 is similar to order
it replaces, except it increases the total maximum membership of the Board from four to five, and clarifies ARB procedural authority and further
delineates the authority and responsibilities of the Secretary.

Final rule amends the OFCCP hearing rules to expressly
require application of the DOL OALJ Rules of Practice and
Procedure, at 29 CFR Part
18, in all administrative enforcement proceedings against
Government contractors and subcontractors.
Repealed the OFCCP evidentiary regulation at
41 CFR 60-30.18 which proscribed the application of formal rules
of evidence in administrative enforcement proceedings against
Government contractors and subcontractors. The effect of this
repeal is to ensure that the new Department of Labor OALJ uniform
rules of evidence, designed to provide a stable and coherent
framework for resolving evidentiary issues, will be applied in
all such proceedings.
