Definition of Non-Compliant:
The No Fear Act requires that agencies reimburse the Judgment Fund for personnel discrimination payments made in accordance with 28 U.S.C. §§ 2414, 2517, 2672, or 2677. Pursuant to 5 CFR Part 724, reimbursements are to be made within a reasonable amount of time. Upon receipt of a billing letter, an agency has 45 days to either repay the Judgment Fund or contact the Judgment Fund to make arrangements for a payment schedule. An agency is non-compliant if they fail to reimburse or make timely arrangements for reimbursement. As required by 5 CFR 724.105, the Financial Management Service is posting this annual non-compliance report on the FMS website.
