SUBJECT: Submission of the 1995 Annual Ethics Training Plan


Submission of the 1995 Annual Ethics Training Plan

Each Designated Agency Ethics Official (DAEO) is required to submit a written plan for annual ethics training (training plan) for calendar year 1995 to the Office of Government Ethics (OGE) by August 31, 1994.


Content of the Training Plan

The training regulation, as modified by the recent interim rule amendments, requires the training plan to contain the following six items (see 5 C.F.R. § 2638.702(a)(3); 59 Federal Register 12145, 12148 (March 16, 1994)):

 an estimate of the total number of agency employees who must be provided annual ethics training;  an estimate of the number of agency employees to whom the annual ethics training course will be provided by means of written materials under the exception provided at 5 C.F.R. § 2638.704(d)(2)(i), together with a written description of the basis for allowing the exception;

 estimates of the number of special Government employees and the number of officers in the uniformed services who serve for 30 or fewer consecutive days to whom the annual ethics training course will be provided by means of written materials under the exceptions provided at 5 C.F.R. § 2638.704(d)(2)(ii) and (iii);

 an estimate of the number of training classes to be provided during the calendar year;

 an estimate of the average class size; and

 any other information that the DAEO believes will facilitate OGE's review of the agency's planned ethics training program.


Complete the Attached 1995 Annual Ethics Training Plan

Please complete and submit the attached 1995 Annual Ethics Training Plan to OGE by August 31, 1994. All estimates must be completed. Please state "0" or "Not Applicable" when necessary. OGE is not requesting additional administrative information for the 1995 training plans.

Agencies are reminded that the interim rule amendments require annual ethics training to be presented verbally, either in person or by telecommunications, computer-based methods or recorded means. 59 Federal Register 12145, 12149 (March 16, 1994). Although the exception to provide training to a particular employee or group of employees by means of written materials still exists (5 C.F.R. § 2638.704(d)(2)(i)), OGE does not expect this exception to be widely used because agencies can now use telecommunications, computer-based methods, or recorded means to accomplish annual training. Should an agency use this exception, a written description of the basis for allowing an exception must be included in the training plan. Agencies do not have to provide a written description for using the exceptions for special Government employees and officers in the uniformed services who serve on active duty for 30 or fewer consecutive days (5 C.F.R. § 2638.704(d)(2)(ii) and (iii)).
