SUBJECT: Attorney General's Statement of Covered Activities Required by Section 4(d) of Executive Order 12834


On January 20, 1993, President Clinton signed Executive Order 12834 entitled "Ethics Commitments by Executive Branch Appointees." See 58 Fed. Reg. 5911-5916 (Jan. 22, 1993). One of the administrative requirements of the Executive order (sec. 4(d)) was for the Attorney General to publish within six months of the issuance of the order a--

'Statement of Covered Activities,' based on the statute, applicable regulations and published guidelines, and any other material reflecting the Attorney General's current interpretation of the law, describing in sufficient detail to provide adequate guidance the activities on behalf of a foreign government or foreign political party which, if undertaken as of January 20, 1993, would require a person to register as an agent for such foreign government or political party under the Foreign Agents Registration Act of 1938, as amended.

The Department of Justice recently published this Statement of Covered Activities. See 58 Fed. Reg. 39444-39445 (July 23, 1993). A copy of this Statement is attached for your use. Please provide a copy of this Statement to every senior appointee in your agency who has been required or, in the future, who will be required to execute a pledge pursuant to Executive Order 12834. As a reminder, this Office issued the pledge forms that must be executed by both senior appointees and trade negotiators covered by E.O. 12834 as an attachment to a memorandum to all Designated Agency Ethics Officials dated January 22, 1993.
