CONCERNING DEBT COLLECTION PROCEDURES


The Nuclear Regulatory Commission is seeking public comment on a proposal to amend its regulations concerning procedures used to collect outstanding debts.

The proposed rule change would make it easier for NRC to collect outstanding debts including enabling the agency to refer any debt over 180 days delinquent to the Department of Treasury for collection. The proposed rule change would amend Part 15 of Title 10 of the Code of Federal Regulations to ensure conformity with the Debt Collection Improvement Act of 1996 and the amended procedures of the Federal Claims Collection Standards issued by the Department of Treasury and the Department of Justice.

Under current practice, NRC sends three progressively stronger demands for payment to a debtor at 30 day intervals. Under the proposed change, NRC would make two written demands and a telephone call to the debtor before pursuing administrative remedies, which can include license revocation.

Interested persons are invited to submit comments on the proposed rule within 75 days after publication of a Federal Register notice on this subject, expected shortly.
