NRC BANS PRESIDENT OF PENNSYLVANIA COMPANY FROM NRC-LICENSED ACTIVITIES FOR THREE YEARS

The Nuclear Regulatory Commission staff has issued an order banning David D. Klepadlo from NRC-licensed activities for three years for providing false information to the NRC regarding the location of two gauges containing radioactive material. The order is effective immediately.

Mr. Klepadlo is the president of David D. Klepadlo & Associates in Moosic, Pa. The company's license to possess two gauges was revoked by the NRC in August 1999 for non-payment of fees. During a phone conversation with an NRC inspector and in a letter to the NRC, Mr. Klepadlo claimed the gauges had been transferred back to the manufacturer. When repeated attempts by the NRC to verify the disposition of the gauges failed, the NRC conducted an inspection at the company's facility in February of this year. The inspector found both gauges stored at the facility.

The NRC has concluded that Mr. Klepadlo violated the requirement that information provided to the NRC be complete and accurate in all material respects, and caused his company to be in violation of NRC requirements.

In the order, Carl J. Paperiello, NRC Deputy Executive Director for Materials, Research and State Programs, said, "deliberately and knowingly providing false information to the NRC calls into question his [Mr. Klepadlo's] trustworthiness and reliability, and raises serious questions as to whether he can be relied up to comply with NRC requirements and to provide complete and accurate information to the NRC."

Mr. Klepadlo has 20 days to respond to this order.
