NRC STAFF PROPOSES ISSUANCE OF OPERATING LICENSE TO THE U.S. AIR FORCE

FOR AN EXISTING NUCLEAR RESEARCH REACTOR AT MCCLELLAN AIR FORCE BASE

The U.S. Nuclear Regulatory Commission staff is considering issuing an operating license to the U.S. Air Force for an existing research reactor at McClellan Air Force Base in Sacramento, Calif.

The facility is presently operating under the authority of the Department of Defense and is being used for research. The new license would authorize the Air Force to operate the reactor as a research tool under the authority of the NRC at power levels not to exceed 2.3 megawatts thermal, its current capacity. The Air Force is seeking an NRC license as part of an effort to expand its use of private industry in conducting research on its behalf.

Prior to issuance of the license, the facility will be inspected by NRC staff to determine whether it has been constructed in accordance with the application submitted by the Air Force. . Any member of the public whose interest may be affected and who wishes to participate in the hearing process must file a written request for a hearing and a petition for leave to intervene by October 31.

Interested persons should consult a copy of Title 10 of the Code of Federal Regulations Chapter 2.714 for an explanation of the hearing and intervention process. A copy of the applicable regulation is available at the NRC Public Document Room (PDR), 2120 L Street, NW, Washington, D.C., or by calling the PDR at (202) 634-3273.

A request for a hearing or a petition for leave to intervene must be filed with the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, D.C., 20555-0001, Attention: Rulemakings and Adjudications Staff, or may be delivered to the PDR. A copy of the petition should also be sent to the Office of the General Counsel, U.S. Nuclear Regulatory Commission, Washington, D.C., 20555-0001, and to Col. Robert Gibson, SM-ALC/JA, 5219 Arnold Avenue, McClellan AFB, Sacramento, CA 95652-1085, attorney for the licensee.
