Assistant to the General Counsel for Legislation and Litigation

The Assistant to the General Counsel for Legislation and Litigation (L&L) supervises staff attorneys and support staff. The principal clients of the Office of the Assistant to the General Counsel (L&L) are the Assistant Secretary for Legislative Affairs and the Executive Secretary.

The Office of the Assistant to the General Counsel (L&L) works closely with the Assistant Secretary for Legislative Affairs to provide legal and other support for the Department’s work on major legislative matters. The Office also coordinates requests from the Office of Management and Budget and Congress for the views of the Treasury Department on a broad range of legislation, testimony, Executive branch reports, and proposed Executive orders and memoranda.

The Office of the Assistant to the General Counsel (L&L) monitors and reviews for the General Counsel and Deputy General Counsel significant litigation to which the Department is a party or has an interest and manages the Department’s response on individual significant cases as designated by the General Counsel. The Office also serves as a liaison with the Justice Department in reviewing litigation of interest to the Federal government and works with each Treasury bureau to develop recommendations on significant litigation matters.

The Office coordinates issues of general interest within the Legal Division and serves a broad "of counsel" function with respect to legislative and litigation matters. The Office undertakes special assignments as requested by the General Counsel or the Deputy General Counsel.

Examples of significant projects on which the office provided legal advice include serving as the Treasury Department liaison to the 9-11 Commission, counseling Treasury clients and drafting legislative language for the Intelligence Reform Act, responding to Congressional oversight requests, advising Treasury clients and working with the Justice Department on subpoenas to current and former Treasury officials in third-party litigation, and providing counsel on significant IRS litigation pending before Federal district courts and courts of appeal.
