Proposed Common Patent Prosecution, Examination Search, and Publication Data Elements and Populated Attributes
I. Background
Patent data elements have been developed under several projects of the U.S. Patent and Trademark Office (USPTO), the European Patent Office (EPO), Japanese Patent Office (JPO), and the World Intellectual Property Organization (WIPO). The elements developed to date are of value in the context in which they were developed, but are not entirely compatible with one another outside of these specific contexts.
In the framework of Trilateral cooperation, the Data Administration Division of the USPTO recognizes that a single point of reference for all patent data elements from the EPO, JPO, and WIPO is needed to facilitate the USPTO’s coordination with our Trilateral partners. To achieve this objective, the patent data elements from all Trilateral partners need to be reconciled in order to develop a well integrated, "common" interchange patent data dictionary. This common dictionary will contribute to both the ongoing and planned development and integration of prototype and operational systems that support electronic commerce in the intellectual property community.
The original Common Trilateral Patent Application Data Elements document was completed in January 1996 based on a need to exchange common patent information among the EPO, USPTO, and WIPO. The document contained a list of common patent application data elements that are used and proposed in the EPO’s Data Catalogue, the Electronic Filing Interchange Data dictionary of the PTO’s Electronic Application System (EASY) project, and the patent application recommended fields in Section ST. 32 of WIPO.
In June 1996, the EPO Data Catalogue was updated, along with its data model. A copy was provided to the USPTO. Data elements in this new document were analyzed and updated into the Common Trilateral Patent Application Data Elements
At the Trilateral meeting in Tokyo in June 1997, a copy of the Common Trilateral Patent Application Data Elements document was given to the JPO representatives. In August 1997, the JPO sent approximately 350 patent related data elements to the USPTO and requested that they be included in the analysis and added to the document. The JPO data elements were analyzed and incorporated into the document.
At the presentation of the Common Trilateral Patent Application Data Elements to the Trilateral partners in the USPTO in October 1997, the EPO and JPO representatives expressed an interest to add patent prosecution, examination search, and publication data elements into the dictionary.
In January 1998, the USPTO began an effort to expand the dictionary to include patent prosecution, examination search, and publication data elements. A preliminary draft document listing these data elements was distributed to the EPO and JPO in January 1998. Since then, the Common Trilateral Patent Application Data Elements document was revised to reflect the Trilateral partners’ request, adding detail information into each patent prosecution, examination search, and publication data element. The dictionary was renamed as the Common Trilateral Data Dictionary.
In June 1998, the USPTO presented the data dictionary during the Trilateral Technical Meeting, seeking consensus and approval to expand the scope of the dictionary to include PCT, patent examination, prosecution, and amendment data elements. Electronic and hard copies were provided to the EPO, JPO, and WIPO for review and comment. The request to expand the dictionary was approved, targeting patent prosecution, search and publication data elements at the next release.
Since the June 1998 Trilateral Technical Meeting, the USPTO has reviewed the existing 184 patent prosecution, examination, and publication data elements. These data elements define information ranging from patent additional enclosure document, patent claim, drawing, amendment to patent case review process, extension, reexamination, and search data such as non patent literature material and international patent information.
The following report includes the populated metadata attributed for each of the patent prosecution, examination search, and publication data elements proposed as common interchange data elements.
A table of contents precedes the report.
III. Future Activities
Several on-going USPTO automated information system (AIS) projects - the Patent Cooperation Treaty Operations Workflow and Electronic Review (POWER) system, the Office Action and Correspondence System (OACS) and the International Priority Document Exchange (IPDE) project - have emphasized the need to establish a final set of patent prosecution, search and publication data elements for Trilateral data exchange purposes. The USPTO has continued to refine these data elements. However, input from other participating Trilateral offices is necessary so that a comparison and analysis of the data elements can be performed. Once such an analysis is completed, a final list of patent prosecution, search and publication data elements will be presented to the Trilateral for confirmation and acceptance.
Adopt the Common Trilateral Data Dictionary as a Trilateral standard and update and maintain it as the Trilateral Partners further collaborate on automated information system (AIS) projects and data exchange. The Trilateral Partners should place emphasis on reviewing and commenting on the list of patent prosecution, search and publication data elements. The Common Trilateral Data Dictionary will then be revised to reflect the data needs for all Trilateral data exchange and AIS projects.
