Revision of Forms to Implement
The Consolidated Appropriations Act, 2005

The Consolidated Appropriations Act, 2005 (P.L. 108-447) (Consolidated Appropriations Act) was signed by the President and enacted into law on December 8, 2004. The Consolidated Appropriations Act revises certain patent application fees; provides separate fees for a basic filing fee, a search fee, and an examination fee; and requires an additional application size fee for any patent application whose specification and drawings exceed 100 sheets of paper (excluding sequence listing or computer program listing filed in an electronic medium in compliance with 37 CFR 1.52(e)). Forms PTO/SB/06, PTO/SB/17, PTO/SB/22, PTO/SB/56, and PTO/SB/13/PCT have been revised to implement the Consolidated Appropriations Act.

In addition, the following fees were removed from the “Other Fees” section of form PTO/SB/17 (rev. 11-04) because other PTO forms (listed below) already provide for the payment of these fees:

  • Extension of time fees are located on form PTO/SB/22

  • Notice of Appeal fee is located on form PTO/SB/31

  • Request for Oral Hearing fee is located on form PTO/SB/32


  • For the other fees that were removed (e.g., information disclosure statement fee, the 37 CFR 1.17(q) processing fee and the fee for filing a brief in support of appeal), payment information can be included in a transmittal letter.
