The Facts About . . .Drug Free Workplaces

The Drug-Free Workplace Act of 1998 established a Drug-Free Workplace Demonstration Program within the U.S. Small Business Administration. The Act allows SBA to make grants to eligible intermediaries to assist small businesses financially and technically in establishing drug-free workplace (DFWP) programs.

The Act defines an eligible intermediary as an organization that:

  • has at least two years of experience in carrying out DFWP programs;
  • has a drug-free workplace policy in effect;
  • is located in a State, the District of Columbia, or a territory of the United States; and
  • has as its purpose the development of comprehensive drug-free workplace programs, or supplying drug-free workplace services, or providing other forms of assistance and services to small businesses.


The Act also allows SBA to provide contracts to the Small Business Development Centers to provide information and assistance to small businesses with respect to establishing DFWP programs.

As outlined in the Act, a complete DFWP program contains the following elements:

  • a written policy;
  • drug and alcohol abuse prevention training;
  • drug testing;
  • an employee assistance program (EAP); and
  • continuing education.


Among the activities that will be performed by the grant and contract recipients are:

  • Providing financial assistance to small businesses as they set up DFWP Programs. This may include free and/or reduced costs for training sessions, management/supervisor consultants, EAP services and/or drug testing, etc.
  • Providing technical assistance to small businesses as they set up DFWP Programs. This may include performing needs assessments, writing/reviewing policies & procedures, providing consultation to management on program development, providing consultation to supervisors on when & how to enforce the DFWP policy & how to make referrals to drug testing or EAPs, etc.
  • Educating small business employers and employees on the benefits of a drug-free workplace.
  • Educating parents that work for small businesses on how to keep their children drug-free.
