REPORT TITLE: Driver Improvement DESCRIPTION: Requires a driver improvement program for any motor vehicle driver who drives a motor vehicle with a gross vehicle weight rating of over 10,000 pounds. HOUSE OF REPRESENTATIVES H.B. NO.10 TWENTIETH LEGISLATURE, 1999 STATE OF HAWAII ________________________________________________________________ ________________________________________________________________ A BILL FOR AN ACT RELATING TO MOTOR VEHICLES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: 1 SECTION 1. The purpose of this Act is to limit requirements 2 for remedial safety training in the driver improvement program to 3 drivers of vehicles over ten thousand pounds gross vehicle 4 weight, in order to be consistent with federal safety 5 regulations. 6 SECTION 2. Section 286-202.5, Hawaii Revised Statutes, is 7 amended by amending subsections (a) and (b) to read as follows: 8 "(a) Every employer who employs a commercial motor vehicle 9 driver [as categorized in section 286-239, or a category (4) 10 driver in section 286-102,] who drives a motor vehicle with a 11 gross vehicle weight rating in excess of ten thousand pounds 12 shall provide for every such driver a driver improvement program. 13 This program shall provide a system for continuous driver 14 evaluation and annual driver safety courses approved by the 15 director. For drivers with five years of continuous employment 16 with one employer, this requirement shall be at least once every 17 two years. Every job placement center through which a [category 18 (4) or commercial motor vehicle] driver who drives a motor 19 vehicle with a gross vehicle weight rating in excess of ten Page 2 H.B. NO.10 1 thousand pounds is employed on a casual or sporadic basis, and 2 not as a regularly employed driver for any one employer, shall be 3 responsible for providing the driver improvement program for all 4 its [category (4) and commercial motor vehicle] drivers[.], who 5 drive a motor vehicle with a gross vehicle weight rating in 6 excess of ten thousand pounds. For purposes of this subsection 7 only, "job placement center" means any place where persons may 8 register for purposes of employment, and the dispatching of those 9 persons to various jobs as they become available. Any employer 10 or job placement center that violates this subsection shall be 11 fined not more than $500. 12 (b) Every regularly or casually employed driver of a 13 [category (4) vehicle or a commercial] motor vehicle with a gross 14 vehicle weight rating in excess of ten thousand pounds shall 15 attend the driver improvement program provided by the driver's 16 employer or job placement center. The director shall adopt rules 17 pursuant to chapter 91 necessary for the purposes of this 18 subsection, including but not limited to rules governing 19 attendance. Any driver who does not fulfill the appropriate 20 driver improvement attendance requirement shall be fined not more 21 than $100." 22 SECTION 3.
