REPORT TITLE: Wastewater special fund DESCRIPTION: Creates the wastewater treatment certification board special fund to certify individuals to operate wastewater treatment plants. (SB207 HD2) 207 THE SENATE S.B. NO. H.D. 2 TWENTIETH LEGISLATURE, 1999 STATE OF HAWAII ________________________________________________________________ ________________________________________________________________ A BILL FOR AN ACT RELATING TO WASTEWATER. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: 1 SECTION 1. Chapter 340B, Hawaii Revised Statutes, is 2 amended by adding a new section to be appropriately designated 3 and to read as follows: 4 "�0B- Wastewater treatment certification board special 5 fund. (a) There is established in the state treasury a special 6 fund to be known as the wastewater treatment certification board 7 special fund. The following moneys collected by the board shall 8 be deposited into the special fund: 9 (1) Registration fees for examinations; 10 (2) Renewal fees; 11 (3) Reciprocity fees; and 12 (4) Temporary certificates fees. 13 All interest earned or accrued on moneys deposited into the 14 special fund shall become a part of the special fund. 15 (b) All moneys paid into the special fund shall be expended 16 by the board to finance its operations." 17 SECTION 2. Section 340B-11, Hawaii Revised Statutes, is 18 amended to read as follows: 19 "[[]�0B-11[]] Powers and duties of the board. To carry 20 out the provisions and purposes of this chapter, the board shall: Page 2 207 S.B. NO. H.D. 2 1 2 (1) Perform any and all acts and adopt, amend, or repeal 3 such rules [and regulations] as it finds necessary or 4 appropriate; 5 (2) Enter into agreements, contracts, or cooperative 6 arrangements, under such terms and conditions as deemed 7 appropriate with other state, federal, or interstate 8 agencies, municipalities, educational institutions, or 9 other organizations or individuals; 10 (3) Receive financial and technical assistance from the 11 federal government and other public or private 12 agencies; 13 (4) Participate in related programs of the federal 14 government, other states, interstate agencies, or other 15 public or private agencies or organizations; 16 (5) Furnish upon request to federal, state, or interstate 17 agencies, municipalities, educational institutions and 18 other organizations and individuals, reports, 19 information, and materials relating to the 20 certification program authorized by this chapter; 21 (6) Revoke, suspend, or refuse to renew any certificate of 22 any individual following a hearing before the board of 23 the individual or the individual's designated Page 3 207 S.B. H.D. 2 1 representative, when it is determined that the 2 individual has practiced fraud or deception; that 3 reasonable care, judgment, or the application of the 4 individual's knowledge or ability was not used in the 5 performance of the individual's duties; or that the 6 individual is incompetent or unable to properly perform 7 the individual's duties; provided that the board gives 8 the person concerned notice and hearing in conformity 9 with chapter 91; 10 (7) Delegate those duties and responsibilities the board 11 may deem appropriate for the purpose of administering 12 requirements of this chapter; 13 (8) Establish and collect such fees for application, 14 conduct examinations, issue or renew certificates as 15 are necessary for the support of this chapter, and 16 deposit all fees collected into the [State's general] 17 wastewater treatment certification board special fund; 18 and 19 (9) Oversee the development and implementation of a 20 continuous training program if that is necessary to 21 carry out this chapter." 22 SECTION 3. Statutory material to be repealed is bracketed. 23 New statutory material is underscored. 24 SECTION 4. This Act shall take effect upon its approval.
