All Agencies Comply with No FEAR Act Requirements

Treasury's Financial Management Service (FMS) announced today that all federal government agencies have complied with the Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002 (the No FEAR Act) requirements and have either reimbursed the Judgment Fund for payments made on their behalf, or have set up repayment plans.

The No FEAR Act (5 U.S.C. 2301 Note) requires agencies to reimburse the Judgment Fund for payments in connection with judgments against agencies for discrimination against particular individuals or groups. The Act also requires agencies to post the No FEAR data on their websites, and it requires FMS to post, on an annual basis, a listing of agencies failing to either repay the Judgment Fund, or to make arrangements in writing for a reimbursement plan, within 45 days of an FMS notice for reimbursement, as directed in OPM's interim final rule, 5 CFR Part 724.
