For First Time, WV Elects District Officials on General Ballot

In 2004 a suit was filed with the West Virginia Supreme Court of Appeals challenging the West Virginia Conservation Committee on the rules governing the election of conservation district officials.

Previously, the WV Code 19-21A provided that only those persons who are owners of at least three (3) acres of land and are twenty-one years of age may vote for conservation district officials. Each district administered the election by placing ballot boxes at farm and agricultural businesses located throughout the county. Districts announced the elections through legal advertisements in local newspapers.

The law suit stated that prohibiting owners of property who are not yet twenty-one from voting is in violation of the U.S. Constitution Amendment XXVI, 1, which provides that, “no State shall…deny to any person within its jurisdiction the equal protection of the laws.” The suit also pointed out that the requirement for voters to own land was not constitutional, and discriminated against tax payers who do not own land.
