RELATING TO LODGING OR TENEMENT HOUSES, HOTELS, AND BOArDINGHOUSES.

Eliminates the issue of a county business license to operate lodging or tenement houses, hotels, and boardinghouses and repeals the $10 annual license fee.

relating to the tourism special fund.

Caps tourism special fund at $50 million annually; diverts the remainder to the Park Acquisition Trust Fund.

Requires "gross" rather than "net" proceeds from convention center activities to be deposited into the convention center capital and operations special fund.

RELATING TO TOURISM.

Increases the membership of the Hawaii Tourism Authority, and assigns the responsibility to market, operate, manage, and maintain the Hawaii convention center facility to the HTA. Increases, the transient accomodation tax rate by 1 per cent for every increase of 500,000 visitors over 7,500,000 until the tax rate is 10.25 per cent.

RELATING TO TOURISM MARKETING.

Proposes to dedicate a portion of the Hawaii Tourism Special Fund to market Hawaii as a place where business can take place, particularly in areas where Hawaii is globally competitive.

Amends definition of "cooler beverage" to mean any liquor containing less than 7% alcohol by volume.

Bans minors from entering clubs or cabarets except for minors 18 years of age or older who are lawfully employed by the club or cabaret.

RELATING TO INTOXICATING LIQUORS.

Authorizes reciprocal shipping of intoxicating liquor under specified conditions.

relating to publication of notice.

Exempts counties from definition of government agency except for procurement code and health and human services contracts. Allows the comptroller to determine a publication on each island to which the public can go to as one source for notices from a government agency.

relating to restraint of trade.

Clarifies that attorneys fees and costs may not be awarded to the plaintiff in an unfair trade practice suit brought by the State or a county; allows threefold compensatory damages for injuries sustained to property from unfair or deceptive trade practices; requires that consent decrees entered into before the filing of an action do not become final until 60 days from the filing of the consent judgment or decree or until final determination of exceptions.

RELATING TO PUBLIC UTILITIES.

Expands the exemption from Public Utilities Commission regulations to include public utilities owned and not operated by the State or its political subdivisions, provided that the State or its political subdivisions shall not use fees generated by the operation of utilities owned but not operated by the State or its political subdivisions for general funded operations or non-utility related expenses or projects.

Appropriates funds to increase the resources of the department of land and natural resources to prevent and fight wildfires which for the purpose of preventing road closures.

WRITTEN TESTIMONY: Persons wishing to submit written testimony should submit 25 copies of their testimony to the committee clerk, Room 218, State Capitol 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.

oral testimony: persons wishing to testify at the hearing must register to testify PRIOR TO THE HEARING by calling the committee clerk or filling out a testimony form prior to the start of the hearing. PERSONS MUST REGISTER TO TESTIFY EVEN IF WRITTEN TESTIMONY HAS ALREADY BEEN SUBMITTED. TESTIMONY AT THE HEARING WILL BE LIMITED TO THREE (3) MINUTES FOR EACH TESTIFIER.
