Freedom of Information Act

The Freedom of Information Act (FOIA) provides that any person has the right to request access to Federal agency records.  The CFTC is required to disclose records upon receiving a written request for them, except for those records that are protected from disclosure by the nine exemptions and three exclusions of the FOIA. This right of access is enforceable in court.  The CFTC maintains public and non-public records.

Publicly-available information
Most of the CFTC’s public information is available on our website.  Browse especially:

and see our list of frequently requested information under FOIA.

The CFTC Reading Room at our Headquarters office also provides access to public information.

Non-public records
A FOIA request is required to obtain non-public records.  We will release non-public records that are not exempt from disclosure under the FOIA.  If we can reasonably segregate or delete exempt information from a requested record, we will release the rest of the record to you.
