Dear State Shellfish Control Official:
 
Enclosed are several copies of the newly approved Interstate Shellfish
Dealer's, FDA Form 3038 (9/94). This form was approved by the Office of
Management and Budget and replaces the previous Forms FDA 3038b and FDA
3038c. Previous editions of Forms FDA 3038b and FDA 3038c will no longer be
accepted. Also the previous letter of April 22, 1 994 with instructions to
submit certification information is no longer required to accompany the FDA
3038 (9/94).
 
Effective January 1, 1995, the new form will be required to be submitted by
the State Shellfish Control Agencies. All new listings and renewals of
listing must be submitted via this new form FDA 3038 (9/94). All information
required by the new FDA 3038 must be submitted, any form with incomplete
information will be returned and will not be published.
 
Starting with the February 1995 ICSSL and thereafter the form FDA 3038 (9!94)
must be mailed not later than the 1Oth of each month in order to allow time
for review and mail the list on time to be published.
 
Instructions for completing the Form FDA 3038 (9/94) are enclosed.

Interstate Shellfish Dealer's Certificate
 
 
General Instructions
 
 
The National Shellfish Sanitation Program (NSSP) requires that states certify
dealers for interstate shipment in accordance with the sanitation and
administrative criteria of the Manual of Operations, Part II.  Under the NSSP,
the state shall keep records which document that applicable criteria have been
applied to all certified dealers.  The state shall conduct inspections with the
frequency required by the NSSP at a minimum and more often if needed to ensure
that satisfactory operational and sanitation conditions are maintained.
Dealers not meeting the minimum sanitation criteria shall not be eligible for
inclusion in the Interstate Certified Shellfish Shippers List (ICSSL).  The
certificate will allow the Food and Drug Administration (FDA) to collect the
necessary information to list certified dealers in the ICSSL.

Instructions For Completing Form FDA 3038
 
 
The original copy, or Part 1, of the Shellfish Dealer's Certificate is mailed
to FDA, Shellfish Program Implementation Branch, Division of Cooperative
Programs, HFS-628, 200 "C" Street, SW, Washington, DC 20204; Part 2 is mailed
to FDA Regional Shellfish Specialist; and Part 3 is retained by the State
Regulatory Agency.  The original certificate shall be mailed not later than the
tenth (1Oth) of the month for publication in the ICSSL.
 
 
Section I - Completed by State Shellfish Regulatory Agency
 
 
Check One Certification or Cancellation when submitting this form.
 
     1.   Shellfish Dealer/Shipper:  Name, Address (including Street, Number,
          City or Town) ZIP, Telephone
 
     2.   Certification:  a) Certification No. - a unique number assigned to
          each certified shellfish dealer; b) Date Certified - date the plant
          was certified as meeting the NSSP criteria (Note:  use this box to
          indicate date when the dealer/shipper is Decertified, Out of Business
          or Other); c) State - Two letter State code; d) Expiration Date -
          date certificate expires must be in accordance with the State
          expiration; e) Category Symbol - two letter code designating dealer
          process.
 
     3.   Date of On-Site Inspection:  Date the plant was inspected for
          certification.
 
     4.   Name of Standardized State Shellfish Plant Inspector: Printed name of
          inspector who conducted the on-site inspection.
 
     5.   Expiration Date of Inspector's Certificate of Standardization:  Print
          the expiration date that appears on the Inspector's certificate.
 
     6.   Cancellation Date:  Date firm has been either decertified or
          recommended for delisting.
 
     7.   Reason for Cancellation:  Check applicable box; Other denotes
          voluntary or seasonal suspension of activities.
 
     8.   State Shellfish Certification Officer:  Printed name and signature of
          official to authenticate information.  In the case that a state has
          only one Standardized State Shellfish Plant Inspector, sign this
          block.  Date Certificate sent to FDA:  Self explanatory.
 
 
Section II Completed by FDA, Division of Cooperative Programs.
 
 
     9.   Date Certificate Received:  Date the signed original Form FDA 3038 is
          received by FDA.
 
     10.  Date Certification Published:  Date when the certified dealer's name
