Federal Acquisition Regulation Provisions and Clauses for Purchasing Biobased Products
On November 7, 2007, the Federal Acquisition Regulation was amended to add provisions for implementing the biobased product purchasing requirements of the Farm Security and Rural Investment Act of 2002. Among other things, the new FAR provisions make clear that (1) agencies must consider purchasing biobased products when doing acquisition planning and describing their needs, (2) the requirements to purchase biobased products apply when government purchase cards are used to make a purchase, and (3) the requirements to purchase biobased products apply to services contracts under which such products will be supplied or used. The FAR amendments also include a biobased product certification provision for contract solicitations and a biobased product clause for services and construction contracts.
