Roger J. Klurfeld
Director USDA National Appeals Division
Roger J. Klurfeld was appointed Director of the National
Appeals Division in the Office of the Secretary at the U.S. Department
of Agriculture in June 2002. The Division is responsible for
all administrative appeals arising from program decisions of
the Farm Service Agency, Risk Management Agency, Natural Resources
Conservation Service, Rural Business-Cooperative Development
Service, Rural Housing Service, and the Rural Utilities Service.
As Director, Mr. Klurfeld supervises a national office staff
located in Alexandria, Virginia; three three regional offices
located in Indianapolis, Memphis, and Denver; as well as 70 hearing
officers located throughout the United States.
Prior to being named Director of the National Appeals Division,
Mr. Klurfeld was the Assistant Director for Legal Analysis, Office
of Hearings and Appeals, U.S. Department of Energy, Washington,
DC. As Assistant Director, Mr. Klurfeld had general supervisory
responsibility over the DOE’s program to refund billions
of dollars obtained from overcharges by oil companies during
the 1970’s federal price control program, including consideration
of requests by State governments to use oil overcharge moneys
for indirect restitution. Mr. Klurfeld’s staff also processed
requests for waivers from DOE regulations and appeals from orders
issued by other parts of the DOE, including energy efficiency
programs, the Freedom of Information and Privacy Acts, and Payments
Equivalent to Taxes. In addition, Mr. Klurfeld also served as
a Hearing Officer in cases involving personnel security clearance
revocations and the DOE Contractor Employee Protection (whistleblower)
Program.
Mr. Klurfeld is also a founder and President of Nutrition News
Focus, publisher of a web site and newsletter providing analysis
and comment on nutrition stories in the media.
Mr. Klurfeld attended the College of Law, Florida State University,
where he served as Articles Editor of the law review and earned
a J.D. degree with high honors. He also holds an M.B.A. degree
from the College of Business, Florida State University, and a
B.A. degree in public policy from New College in Sarasota, Florida.
Mr. Klurfeld is the author of a number of legal articles. He
has been awarded postgraduate fellowships to study economics
by the National Endowment for the Humanities and the Center for
Law and Economics of the University of Miami. He has lectured
on energy law for Executive Enterprises, Inc., as well as spoken
on energy law issues at national and regional meetings.
He is a member of the District of Columbia and State of Florida
Bars, as well as the bars of a number of federal courts.

Terry Johnson
Deputy Director
USDA National Appeals Division
Ms. Johnson has spent her entire professional career in the
field of administrative hearings and appeals. She came to the
National Appeals Division in November 2002 from the Department
of Health and Human Services, where she had served as a member
of that agency’s five-member Departmental Appeals Board
since her appointment by Secretary Louis Sullivan in 1992. In
addition to holding hearings and deciding appeals, her duties
included providing mediation services and giving lectures on
the appeals process to both agency and customer groups. Prior
to that, Terry was the Board’s Supervising Attorney for
six years.
Ms. Johnson began her government service at the Department
of Energy’s Office of Hearings and Appeals. She served
there as a staff attorney, Deputy Assistant Director, then Assistant
Director.
Ms. Johnson's B.A. degree in political science is from the
University of Nebraska in Lincoln, Nebraska, where she also attended
high school. She received a J.D. cum laude from the
University of Michigan Law School.
