This Notice supersedes Notice PIH 2007-11 (TDHEs), same subject, dated April 30, 2007. This Notice transmits the updated schedule for the maximum amount of funds, from all sources, that may be used for affordable housing under NAHASDA. The requirement for the development and implementation of these limits is found at 24 CFR 1000.156 through 1000.162 of the Indian Housing Block Grant (IHBG) regulations published in the Federal Register on September 28, 2001, and effective October 29, 2001.

This Notice reissues, with minor edits, Notice PIH 2006-19, of the same subject. It serves to clarify the requirements for recipient inspection of housing assisted under NAHASDA and housing assisted under the United States Housing Act of 1937. The purpose of this Notice is to clarify the frequency, reporting requirements, and the expiration of inspection requirements for housing units under the control of Indian Housing Block Grant (IHBG) recipients. HUD has received questions concerning the applicability of inspection requirements found in Section 403(b) of NAHASDA regarding the various types or categories of housing assistance provided and the required frequency of such inspections. It is not the intent of this Notice to define either the content or the scope of inspections of these housing units.

This notice provides information for public housing agencies (PHAs) that wish to submit documentation of successful conversion to asset management in order to discontinue their reduction in operating subsidy under the Operating Fund Program regulations (24 CFR part 990), commonly referred to as the "stop-loss" provision. This notice applies only to PHAs that: (1) lose funding under the new formula; and (2) wish to submit documentation in accordance with the requirements for Year 3.

This notice clarifies the exclusion of guardianship care payments available to children exiting the juvenile court system. The payments made on behalf of the related child to the tenant household is excluded from income certifications pursuant to 24 CFR 5.609(c)(2).

This Notice extends Notice PIH 2007-15 (HA), same subject, which will expire on June 30, 2008, for another year until June 30, 2009. Notice 2007-15 reaffirms the requirements of Public and Indian Housing Programs including the United States Housing Act of 1937, the ACC, and regulations that apply to public housing activities, including mixed-finance development activities. The Notice also assists PHAs in avoiding violations of existing requirements in development transactions with their partners.

This Notice strongly encourages Public Housing Agencies (PHAs) to use solar, wind and other renewable energy sources, and other "green" construction and rehab techniques whenever they procure for maintenance, construction, or modernization. This Notice defines green building principles for construction practices in Public Housing, identifies the benefits of green construction and rehabilitation practices and products, and identifies expertise that is available to provide valuable assistance for implementing such practices. Properly incorporating green building techniques supports the goals of the President's National Energy Policy by reducing the burden of public housing energy costs while increasing comfort and reducing health risks to public housing residents, and minimizes life-cycle costs.

This Notice extends Notice PIH 2007-12 (HA), same subject, which will expire on May 31, 2008, for another year until May 31, 2009.

The purpose of this Notice is to inform public housing agencies (PHAs) and Tribally Designated Housing Entities (TDHEs) about Integrated Pest Management (IPM). Reference materials on IPM are located at paragraph seven of this notice. PHAs provide decent, safe, sanitary and affordable housing to more than one million families. Pest problems routinely rate as one of the top concerns by residents.

This Notice serves to reinstate the content of PIH Notice 2006-06 with updates and edits. It provides specific guidance on Energy Performance Contracts (EPCs) with terms up to 20 years, and on subtitle D - Public Housing, Section 151 (2) (B) of the Energy Policy Act of 2005 (PL 109-58). It also provides specific guidance about how existing energy performance contracts (EPCs) may have their terms extended, through a HUD-approved waiver, from the current 12 years up to 20 years. The energy performance contract may be expanded to develop and implement energy efficiency measures to produce additional cost savings that can reasonably be anticipated to service the debt of the new measures. This Notice revises the Disaster Housing Assistance Program (DHAP) Operating Requirements and provides guidance on the transition process for families that are relocating out of FEMA-provided temporary housing units (i.e., travel trailers) directly into the DHAP ("Phase 3 families"). The Notice further revises the Operating Requirements to suspend the incremental rent transition requirement for all Phase 2 and Phase 3 families through March 1, 2009. [...]

This Notice extends Notice PIH 2007-6 (HA), same subject, which will expire on March 31, 2008, for another year until March 31, 2009. Notice PIH 2007-6 (HA) clarified the circumstances under which HUD will consider a voluntary transfer of budget authority and corresponding baseline units for the Housing Choice Voucher program (including Project-Based Vouchers and Project-Based Certificates) from the divesting Public Housing Agency's Consolidated Annual Contributions Contract (CACC) to the receiving agencies' CACC. It also explained the process and procedures associated with such a transfer.

This Notice implements the Housing Choice Voucher (HCV) program funding provisions resulting from enactment of the "Consolidated Appropriations Act, 2008", (Public Law 110-161), referred to hereinafter as "the 2008 Act," enacted on December 26, 2007. The 2008 Act establishes the allocation methodology for calculating housing assistance payments (HAP) renewal funds and continues to prohibit the use of appropriated funds for over-leasing. This Notice extends Notice PIH 2007-1 (HA) that reiterates the streamlined requirements for designating public housing projects for occupancy by elderly families only, disabled families only, or elderly and disabled families only. This Notice also includes the requirements and procedures for renewal of, or changes to, previously HUD approved designation plans.

The Uniform Financial Reporting Standards (UFRS), at 24 C.F.R. § 5.801, require Public Housing Agencies (PHAs) or any other entities , such as non-profit organizations or cities that administer the Housing Choice Voucher (HCV) Program, to submit financial information to the Department of Housing and Urban Development (HUD) electronically. With the issuance of Notice PIH 2006-3 on January 11, 2006, PHAs were reminded of the regulatory requirement to submit their fiscal year end (FYE) financial information to HUD through the Financial Assessment Subsystem for Public Housing (FASS-PH), and to submit certain leasing and cost data through the Voucher Management System (VMS). For some PHAs, this constituted their first year of providing annual financial reports to HUD through FASS-PH. During HUD's review of these submissions, certain common reporting issues were noted. Under NAHASDA, grants are provided to Indian tribes to carry out affordable housing activities. Fiscal Year (FY) 2008 appropriations for HUD (and other federal departments and agencies) were signed into law on December 26, 2007.
