Section 63.71 Application to Discontinue Cable & Wireless USA, Inc. Application to Discontinue Services. On November 19, 2002, Cable & Wireless USA, Inc. (Cable & Wireless or Applicant) located at 8219 Leesburg Pike, Vienna, VA 22182 filed an application with the Federal Communications Commission (FCC or Commission), requesting authority under section 214(a) of the Communications Act of 1934, as amended, and section 63.71 of the Commission's rules to discontinue the provision of certain domestic telecommunications services in specified geographic areas on January 18, 2003. For the reasons indicated below, we grant the application, and allow Cable & Wireless to discontinue the provision of the requested services on January 18, 2003.

Domestic Section 214 Application Filed For Acquisition of Assets of Genuity Telecom Inc. By Level 3 Communications, LLC. On December 16, 2002, Genuity Telecom Inc. ("Telecom"), a wholly-owned subsidiary of Genuity Inc. ("Genuity"), and Level 3 Communications, LLC ("Level 3," collectively, "Applicants"), filed an application pursuant to section 63.04 of the Commission's rules, for consent to the acquisition of substantially all of Telecom's telecommunications carrier assets by Level 3, including: (1) Telecom's U.S. customer base for domestic telecommunications services; (2) and Telecom's domestic common carrier transmission lines. On November 27, 2002, to facilitate the transaction, Genuity and Telecom (along with certain other Genuity subsidiaries) filed for bankruptcy protection under Chapter 11 of the U.S. Bankruptcy Code and entered debtor-in-possession status. FCC Grants Pacific Bell's Application for Authorization under Section 271 of the Act to Provide In-Region, InterLATA Services in the State of California. On September 20, 2002, SBC Communications Inc., and its subsidiaries, Pacific Bell Telephone Company, and Southwestern Bell Communications Services, Inc. (collectively, Pacific Bell) filed this application pursuant to section 271 of the Communications Act of 1934, as amended, for authority to provide in-region, interLATA service originating in the State of California. We grant Pacific Bell's application in this Order based on our conclusion that Pacific Bell has taken the statutorily required steps to open its local exchange markets in California to competition.
