The Assisted Living Federation of America defines Assisted Living as a special combination of housing, supportive services, personalized assistance and healthcare designed to respond to the individual needs of those who need help with activities of daily living. Supportive services are available, 24 hours a day, to meet scheduled and unscheduled needs, in a way that promotes maximum dignity and independence for each resident and involves the resident's family, neighbors and friends.

Assisted Living Choices

Overview

Act 1230 of 2001 authorized the creation of Assisted Living in Arkansas. Prior to Act 1230, Assisted Living was not mentioned in Arkansas law or regulation. This act created, within the Department of Human Services (DHS), an Assisted Living Program for the State of Arkansas. A copy of Act 1230 can be obtained at http://www.arkleg.state.ar.us/.

To provide Assisted Living in Arkansas, one must:

  • Obtain a Permit of Approval from the Arkansas Health Service Permit Agency, and
  • Obtain a License from the AR Department of Human Services Office of Long Term Care.

The Arkansas Department of Human Services (DHS) has issued Regulations for Assisted Living. DHS promulgated the regulations in accordance with the Arkansas Administrative Review Process, which included a 30-day public comment period.

Building an assisted living facility with rents in the $350-$400 per month range is indeed a challenging undertaking. It often requires the use of public financing mechanisms such as tax credits, HOME funds, bonds, Federal Home Loan Bank assistance, and other programs. Often these must be combined or "layered." The Arkansas Development Finance Authority has a set-a-side for affordable assisted living. Their Web page provides information on how to apply for tax credits and HOME funding.

Waiver Provider Information

Living Choices Assisted Living Provider Enrollment

  • A Living Choices Assisted Living Waiver "assisted living services" provider must be licensed as a Level II Assisted Living Facility or licensed as a Class A Home Health Agency who has a contract with a licensed Level II Assisted Living Facility to provide waiver services.

  • A Living Choices Assisted Living Waiver "pharmacist consultant services" provider must be licensed as a pharmacist and certified as a Consultant Pharmacist in Charge issued by the Arkansas State Board of Pharmacy and must have a written agreement with a licensed Level II assisted living facility to perform these services.

  • Providers must be certified by DAAS.

  • Providers must be enrolled with the Division of Medical Services Medicaid Provider Enrollment Unit as a Living Choices Assisted Living provider

Living Choices Assisted Living Waiver
Eligibility & Services

Client Eligibility

To be eligible for Living Choices, you must:

  • Be age 65 and over, or age 21 and over and blind or physically disabled

  • Meet certain financial eligibility requirements as determined by Medicaid that include
    • Monthly Income No More than 300% of SSI
    • Resource Limit
      • $2,000 Individual
      • $3,000 Couple

  • Have medical needs that would require institutional care in a nursing facility at the Intermediate Level, if there were no waiver services. Applicants classified as skilled care patients are not eligible for Living Choices.
    • Must be nursing home placement/level of care eligible (meet medical criteria) as determined by the Utilization Review Section based on information on the DHS-703 completed by the DHS RN.    

To meet medical criteria for the Living Choices waiver program the applicant must meet at least one of the following criteria as determined by a licensed medical professional.

1. The individual is unable to perform either of the following:

(A)  At least one of the three activities of daily living (ADL) of transferring/locomotion, eating or toileting without extensive assistance from or total dependence upon another person; or

(B)  At least two of the three activities of daily living (ADL) of transferring/locomotion, eating or toileting without limited assistance from another person; or,

2. The individual has a primary or secondary diagnosis of Alzheimer’s disease or related dementia and is cognitively impaired so as to require substantial supervision from another individual because he or she engages in inappropriate behaviors which pose serious health or safety hazards to himself or others; or,

3. The individual has a diagnosed medical condition which requires monitoring or assessment at least once a day by a licensed medical professional and the condition, if untreated, would be life threatening.

NOTE: Definitions related to the Nursing Home Admission Criteria
are available from the Division of Aging & Adult Services or
the Division of Medical Services' Office of Long Term Care upon request

 

Application Process

  • It is preferred that applications be made at the DHS County Office in the county where the assisted living facility is located. However, the application can be made in the county of residence and transferred to the county where the facility is located, allowing the application to be made at any DHS county office.

  • The DHS County Office Eligibility Worker will determine financial eligibility and will send a referral to the DAAS RN

  • DAAS will simultaneously collect information for submission to DMS OLTC for medical/nursing home admission and level of care eligibility determination and will complete an assessment and service plan

  • DHS County Office will make the final eligibility determination and open the Medicaid case

  • Client eligibility is reassessed annually

Role of the Assisted Living Waiver
Registered Nurse

  • DAAS Employee

  • Collects information for submission to DMS OLTC for medical/nursing home admission level of care eligibility determination

  • Completes the Comprehensive Assessment and Establishes the Tier of Need

  • Completes the Plan of Care — Updates the Plan of Care annually and at times of significant change

Services

1. Assisted Living Services include:

  • Attendant Care - Assistance with ADLs: mobility & transferring, toileting or incontinence care, eating & drinking, etc.

  • Therapeutic, Social and Recreational Activities

  • Medication Oversight to the extent permitted under State law

  • Medication Administration

  • Periodic Nursing Evaluations

  • Limited Nursing Services

  • Non-Medical Transportation specified in the plan of care

2. Pharmacist Consultant Services

3. Extended Prescription Drug Coverage:

  • Three prescription drugs beyond the Medicaid State Plan Pharmacy Program's monthly benefit limit and extension of that monthly benefit limit

  • This is for only those who are eligible for Medicaid

  • Participants dually eligible for Medicaid and Medicare are not eligible for Extended Prescription Drug Coverage

Reimbursement

  • Medicaid reimbursement to Living Choices Assisted Living Waiver "assisted living services" providers is a daily rate that corresponds to the tier of need in which the DAAS RN places a waiver participant.

    • The determination of the tier of need is based on comprehensive assessment.

    • There are four tiers of need.

    • The daily rate pays for all direct care services in the waiver recipient's plan of care.

  • DAAS will set the assisted living recipient's tier of need and rate for the waiver services in MMIS

  • Medicaid reimbursement for pharmacist consultant services is a daily rate

  • Persons approved for Assisted Living Waiver services may not receive Medicaid State Plan Personal Care

  • Reimbursement is for services only; room and board (rent) are to be paid by the client or his or her legal representative.
