Medicare Prescription Drug Rule (4068-F)
This final rule, published on January 28, 2005 (70 FR 4194) and implementing the provisions of the Medicare Prescription Drug benefit, revised the physician self-referral definition of "outpatient prescription drugs" at ยง411.351 to include outpatient drugs covered under the new Part D benefit.  (See pages 4424 and 4525.)

Nuclear Medicine Proposal (1502-P)
The proposed physician fee schedule rule for calendar year 2006, published on August 8, 2005 (70 FR 45764), included a proposal to add nuclear medicine services and supplies to the designated health service categories of "radiology and certain other imaging services" and "radiation therapy and supplies." (The provisions relating to physician self-referral begin on page 45854.)

  • Correction Notice (1502-CN)
    This correction notice, published on September 1, 2005 (70 FR 52056), made technical corrections to the physician fee schedule proposed rule that was published on August 8, 2005.

Electronic Prescribing and Electronic Health Records (1303-P)
This proposed rule published on October 11, 2005 (70 FR 59182) would create exceptions to the physician self-referral prohibition for certain nonmonetary remuneration related to electronic prescribing technology and electronic health records technology.

Nuclear Medicine Final (1502-FC)
The physician fee schedule final rule for calendar year 2006, published on November 21, 2005 (70 FR 70116), added nuclear medicine services and supplies to the designated health service categories of "radiology and certain other imaging services" and "radiation therapy services and supplies" and also provided the annual update to the List of CPT/HCPCS Codes that defines certain designated health services. (The provisions relating to physician self-referral begin on page 70283.)

Electronic Prescribing and Electronic Health Records (1303-F)
This final rule went on display at the Federal Register on August 1, 2006 (for publication on August 8, 2006), and creates exceptions to the physician self-referral prohibition for certain nonmonetary remuneration related to electronic prescribing technology and electronic health records technology.

Miscellaneous Physician Self-referral Provisions (1385-P; 1385-CN)

The proposed physician fee schedule rule for calendar year 2008, published on July 12, 2007 (72 FR 38122), included several proposals to amend certain provisions of the physician self-referral regulations and sought comments with respect to other issues related to the physician self-referral rules.  (The provisions relating to physician self-referral begin on page 38179.)  A correction notice was published on August 6, 2007 (72 FR 43581).  The document below incorporates the changes identified in the correction notice into the physician self-referral provisions that were included in the physician fee schedule proposed rule.
