218 DM 2

         

2.1     Delegation of Authority.  The Director, Minerals Management Service, is delegated, through the Assistant Secretary - Land and Minerals Management, the Secretary’s authority:

 

          A.      Under the Outer Continental Shelf Lands Act, as amended (43 U.S.C. 1331 et seq.), and Section 105 of the Energy Policy and Conservation Act (42 U.S.C. 6213) to manage and administer programs for the leasing of minerals from, and for the issuance of leases, easements, or rights-of-way for energy-related or other authorized marine-related purposes across, the submerged lands of the Outer Continental Shelf; and

 

          B.      Under sections 2(b)(3), 2(d)(3), 2(e)(3), 4(c), 5(a)(1) and 5(b)(2) of Executive Order 12777 which implement sections 311(j)(1)(C), 311(j)(5), and 311(j)(6)(A) of the Federal Water Pollution Control Act of October 18, 1972, 33 U.S.C. 1321, as amended, and sections 1004(d), 1016(e), 4202(b)(4), and 4303 of the Oil Pollution Act of 1990, 33 U.S.C. 2704, 2716, and 2716a, to manage and administer programs for: (1) oil spill prevention and response planning;  (2) inspections of removal equipment; (3) financial responsibility requirements and the assessment of civil penalties for the violation of financial responsibility requirements; and (4) adjustment of limits of liability to reflect significant increases in the Consumer Price Index, with respect to offshore facilities in federal and state waters, including associated pipelines, other than deepwater ports subject to the Deepwater Ports Act, and

 

          C.      Under section 31 of the Outer Continental Shelf Lands Act, as amended (43 U.S.C. 1356a) to manage and administer the program for the disbursement of $250,000,000 for each of fiscal years 2007 through 2010 to producing states and coastal political subdivisions.

 

2.2     Program Activities.  The activities performed by the Minerals Management Service under the legislation above and other directives of the Department are stated in its organization statement (118 DM 1-7).

 

2.3     Limitation.  The authority granted in 218 DM 2.1 does not include authority which the Secretary may not redelegate as set forth in 200 DM 1.
