Chapter 1: Authority and Scope

1.1 Authority. The authority for the watershed protection program is the Watershed Protection and Flood Prevention Act of August 4, 1954, as amended (16 U.S.C. 1001-1009 (1964 and Supp. IV 1965-1968).

1.3 Administration. Authority for the administration of the Act is vested in the Secretary of Agriculture. The Secretary, in turn, has delegated this authority to the Administrator of the Soil Conservation Service except for the administration of Section 8 and obligations for repayment under Section 4 which have been delegated to the Administrator of the Farmers Home Administration.

1.4 Scope. Works of improvement may be planned and installed on all lands within an approved watershed regardless of ownership. This includes all lands administered by the Department of the Interior.

1.5 Objective. The Act provides additional Federal authority to assist local organizations technically and financially to prevent erosion, flood water, and sediment damages and to further the conservation, development, utilization, and disposal of water, and thereby preserve and protect the Nation=s land and water resources.
