5.1 Delegation of Authority. The authority vested in the Secretary of the Interior under
25 U.S.C. 47, permitting the open market purchasing of products and services produced and performed by Indian Industries, is delegated to the Director of the Minerals Management Service. This delegation provides for the use of the Buy Indian Act to purchase products and services for use by or benefit of Indians, limiting competition to Indian enterprises while operating in complete compliance with the applicable procurement regulations. This authority is limited to mission requirements of the Minerals Revenue Management organization.
5.2 Limitation. This authority mirrors the limitation contained in 218 DM 8.2 requiring all proposed procurements estimated to exceed $1,000,000 to be submitted to the Secretarial Officer having authority over the Service. In addition, this authority is further limited by the policies and regulations that are applicable to any procurement actions initiated under this delegation.
