6.1 Purpose. This Chapter establishes procedures for waiver of regulations in an emergency in accordance with 43 CFR ยง 9.13.
6.2 Approval of Waivers. Pursuant to 209 DM 4, the Assistant Secretary - Policy, Management and Budget is authorized to approve waivers of regulations in 43 CFR Part 9.
6.3 Procedures.
A. Bureau or office requests for waiver shall be in writing, signed by the bureau or office director, reviewed by the appropriate Assistant Secretary, and transmitted to the Office of Acquisition and Property Management for further processing. The waiver request shall fully document the emergency situation which requires the waiver.
B. Documentation of the waiver will be filed in the bureau official grant or cooperative agreement file.
